TERMS AND CONDITIONS OF SALE, DISCLAIMER OF WARRANTY AND LIMITATION OF LIABILITY:
(a) The services are provided "as is" without any warranty of any kind whatsoever, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement or title, which bcvnet disclaims. (b) BCVnet is not liable for: (1) any loss of use, loss of data, interruption of business, or (2) any indirect, special, incidental, consequential, or punitive damages of any kind (including, lost profits) regardless of the form of action, whether in contract, tort (including negligence), strict liability or otherwise, even if BCVnet has been advised of the possibility of these damages. (c) All services are provided on a one year pre-paid term. Cancellation of service requires written notice to BCVnet no less than thirty days before the one year term ends. Failure to provide such notice indicates your agreement to a further one year contract. (d) Your use of BCVnet services indicates that you have read these terms and agree to abide by them.

BCVnet's liability will not exceed the amount customer paid to BCVnet during the 1-month period before the action arose. Customer acknowledges that these limitations are an essential element of this agreement and absent such limitations BCVnet would not enter into this agreement. All insurance for hardware and personal coverage onsite remains the responsibility of the customer.
